Freiburger Bund is a network initiated and operated by Freiburg International Academy GmbH to promote the integration and qualification of professionals in the healthcare sector. Doctors, dentists, pharmacists, and members of other healthcare professions are offered diverse support and opportunities for exchange through Freiburger Bund.

These Terms of Use are intended to regulate the rules for using the services of Freiburger Bund, particularly the platform (https://freiburger-bund.com).

§ 1 Scope

(1) The use of the services of Freiburger Bund (hereinafter referred to as "FB") is governed exclusively by the following Terms of Use in their version valid at the time of use.

(2) FB does not recognize deviating conditions of the User unless Freiburger Bund has expressly consented to their validity in writing.

 

§ 2 Prerequisites for Use

(1) Use of the platforms requires registration. The User is obligated to provide complete and accurate information during registration. In case of incorrect or incomplete information, FB is entitled to block or delete the user account

(2) FB was developed for foreign healthcare professionals who come to Germany to work there. The functions can be used by all professionals who want to come to Germany or are in Germany.

(3) FB offers free services that anyone can use. For paid services, the User enters into a contractual relationship with the service provider. This can be FB or a cooperation partner. The regulations of the respective provider apply to this contractual relationship, not the Terms of Use of FB.

 

§ 3 Registration and Contract Formation

(1) Upon completion of registration, a free-of-charge usage relationship is established between the User and FB in accordance with these Terms of Use.

(2) A contract for further paid services only comes into effect when the User expressly books this service and FB confirms this acceptance in writing or in text form.

(3) Registration is carried out in stages. The User registers for FB and is activated for certain functions. When using the portals in FB, some additional information from Users may be necessary.

(4) FB is entitled to refuse registrations without stating reasons or to block user accounts if there is good cause, particularly in case of violations of these Terms of Use or applicable law.

(5) The User is obligated to provide complete and truthful information during registration and to update changes to their data immediately in the user account. Profile information and application documents are stored. Data is only shared with cooperation partners with the User's express consent. Details regarding storage, access, and deletion of data are described in § 7.

 

§ 4 Platform Services

4.1 Info-Portal

(1) The Information Portal serves to provide content, guidance, and orientation aids for foreign medical professionals in connection with their entry, professional recognition, and integration into the German working world. It supports Users in informing themselves about the essential steps and requirements in the recognition and integration process and in obtaining an overview of relevant topics. Notes on liability and disclaimer are regulated in § 8.

(2) The information offered is structured into four phases. Phase 1 covers topics related to travel planning, entry, the visa process, and application for professional recognition. Phase 2 addresses the steps after entry, particularly professional qualification, recognition procedures, examinations, and granting of license to practice. Phase 3 deals with professional prospects and career paths in Germany, including guidance on applications and basic employment law. Phase 4 provides information on professional development, continuing education, and specialization within the healthcare system.

4.2 Job-Portal

(1) The Job-Portal offers Users the opportunity to inform themselves about current job openings in the medical field. Job offers are provided through the platform that are tailored to the qualifications and interests of foreign medical professionals. Users can apply directly for advertised positions through the Job-Portal.

(2) Additionally, job offers from external providers are published on this portal to cover the broadest possible spectrum of job opportunities. When clicking on an external offer, Users are redirected to the corresponding website. No personal data is transmitted in this process; only the use of the link is recorded anonymously.

(3) Furthermore, recruitment services are offered as a paid service. This includes individual consultation, placement, and support in establishing contact between applicants and employers. Transfer of personal data as part of recruitment services only occurs with the express consent of the person concerned. Upon use of this service, an independent contract is concluded between the person and the provider. This contract is subject exclusively to the terms and conditions established for it and not to these Terms of Use.

4.3 Community-Portal

(1) The Community Portal enables Users to exchange with each other. It is divided into various channels, each covering different topic areas. Users can network, discuss, ask questions, post contributions, comment, learn, debate, and share knowledge here. The channels are intended to create a sense of belonging, promote exchange, and maintain the privacy and security of all Users. Contributions, comments, and messages serve to exchange experiences and provide mutual assistance within the Community.

(2) The Community Portal also offers the option for video calls, both for individual conversations and group conferences. This function serves direct exchange and collaboration within the Community.

(3) The portal relies on user-generated content. Although this is moderated by FB, it cannot be guaranteed that all content is free from unlawful, violent, or offensive representations. FB assumes no liability for such content but commits to promptly reviewing reported violations and removing them if necessary to ensure the protection and security of Users.

(4) Users commit to creating content only under their true identity and keeping it free from bullying, harassment, threats of violence, and other unlawful content. FB reserves the right to immediately delete content that contradicts this principle.

 

§ 5 Regulations (Netiquette)

(1) All Users are invited to actively participate and support each other. Notes on outdated content or comments on articles should be communicated to FB.

(2) All Users commit to behaving respectfully and fairly. When using the platform, the following points must be observed:

  • Behind every contribution is a person: hatred, incitement, or threats of violence toward others are prohibited.
  • Authentic participation: spam, manipulation of content, or other disruptions of the Communities are prohibited.
  • Protection of privacy: personal or confidential data of third parties may not be published without consent.
  • Protection of minors: content with sexually abusive references to minors is strictly prohibited.
  • Truthfulness: users may not intentionally deceive others or impersonate another person.
  • Labeling of content: disturbing, sexually explicit, or offensive content must be clearly labeled.
  • Compliance with law and legislation: no illegal content, calls for criminal acts or promotion of illegal activities.
  • Technical integrity: the functionality of the platform may not be disrupted or impaired.

(3) In case of non-compliance with these regulations, the following actions will be taken:

  • Request to cease and desist
  • Temporary or permanent blocking of the user account
  • Restriction of permissions in individual channels
  • Removal of content
  • Reporting of serious violations to the competent authorities

(4) Users are themselves responsible for the content they post. By posting content, the User grants FB a non-exclusive, worldwide license to use, reproduce, and display this content within the framework of the platform.

 

§ 6 Copyright and Use of Content

(1) All content of FB, particularly texts, articles, images, graphics, and videos, is protected by copyright. Use of the content outside the platform, particularly reproduction, distribution, making publicly accessible, or commercial use, is prohibited without the express written consent of FB.

(2) Third-party content is also protected by copyright. If this is used unlawfully, FB is not liable.

(3) Use of the content outside the platform is only permitted after prior consultation and express written consent of FB. Users can request corresponding permission from FB, which may be granted on a case-by-case basis.

 

§ 7 Data Protection

(1) The processing of personal data is carried out in accordance with applicable data protection regulations.

(2) Profile information and application documents are stored. Data is only shared with cooperation partners with the User's express consent.

(3) Usage data is processed anonymously on the platform for analysis, optimization, and personalization of content. This also includes the anonymized recording of the use of links to external job offers. No personal data is transmitted to external providers in this process.

(4) Further information on data processing is available in the Privacy Policy on the website.

§ 8 Liability and Disclaimer

(1a) General:

FB always strives to keep the published information up to date. However, legal requirements or procedural processes can also change at short notice. FB is therefore not responsible if information is outdated or no longer accurate. Reference is made to the respective sources accordingly. The advice and tips published in this portal are to be regarded as such and do not establish any legal claim of the readers.

(1b) Technical:

FB strives to ensure the greatest possible security of the website. However, FB is not liable for malfunctions, problems, and data loss. It is the User's responsibility to protect the devices from which the internet is accessed through the use of the necessary antivirus and security software.

(1c) Medical:

Medicine is a constantly changing field that is subject to daily further development through advancing research and studies. FB strives to keep the published information up to date in this regard as well, but cannot guarantee providing daily current information here either. FB is therefore not liable for information that is no longer current; Users are required to adhere to the specified sources.

(1d) Experience Reports

The experience reports published on the platform are created and submitted exclusively by Users. FB assumes no responsibility for the completeness or accuracy of the information contained therein. The content of the experience reports is not reviewed or editorially processed by Freiburg International Academy GmbH. Users are themselves responsible for ensuring the accuracy of the content they post. Liability of FB for damages arising from the use of or reliance on the information contained in the experience reports is excluded.

(2) Claims for damages by the User against FB can only be asserted if they are based on intentional or grossly negligent conduct by FB, its legal representatives, or its vicarious agents. This does not affect the User's claim for damages due to breach of essential contractual obligations and due to injury to life, body, or health based on negligent breach of duty by FB, its legal representatives, or its vicarious agents.

(3) FB assumes no guarantee for the completeness, accuracy, timeliness, and availability of the content provided, particularly for job offers and content of the Information Portal. Liability by FB for damages arising from the use or unavailability of the content is excluded.

(4) No liability is assumed for third-party content, particularly also for content from Users of the network.

(5) Otherwise, the statutory provisions apply.

 

§ 9 Usage Relationship, Termination and Blocking

(1) The usage relationship begins with confirmation of registration.

(2) FB may block or terminate the usage relationship in case of violations or for good cause.

(3) Users can delete their user account at any time. The associated data is stored for six months and then deleted, provided no reopening occurs or statutory retention obligations exist. Already published contributions remain to maintain the discussion structure and are anonymized where possible. Existing obligations remain unaffected.

(4) For paid services booked through the platform, the respective separate contractual terms apply. Deletion of the user account or termination of the free-of-charge usage relationship does not release the User from payment obligations for already booked paid services. Refunds or cancellations are governed by the respective contractual terms.

 

§ 10 Changes to Services and Terms of Use

(1) FB reserves the right to modify, expand, or discontinue the platform.

(2) Changes to the Terms of Use are published on the website. Continued use of the platform after publication is deemed consent.
